- DEFINITION AND OBJECT OF THE CONTRACT
1.1. This contract (“Contract”) is a distance contract pursuant to art. 45 and ss. of the Legislative Decree 6 settembre 2005, n. 206 (“Consumer Code”) in the case of consumer customers pursuant to Article 3 of the Consumer Code or, otherwise, a sales contract pursuant to Articles 1470 and ss. c.c.
The Contract concerns the sale of movable property between TELEARTE S.r.l. (hereinafter “TELEARTE”), with registered office in Rome, Via Sebastiano Ziani 54, C.F. n. 06062321002, registered in the Rome Business Register and the customer (the “Customer”). The Contract is concluded directly through the acceptance by TELEARTE of a reservation issued by the Customer by telephone or through the website www.teleartetv.it, following the invitation to offer content in television broadcasts, or on the website web.
2.1. The prices of the products illustrated during TELEARTE television broadcasts and on the website www.teleartetv.it are indicated in Euros and include VAT. and all other taxes. Delivery costs are indicated during television broadcasts, by telephone and on the website www.teleartetv.it, Shipping section. The price payable by the Customer is the one applicable to the conclusion of the Contract.
2.2. If an incorrect price has been advertised, TELEARTE will contact the Customer to check whether it intends to proceed with the purchase of the product at the correct price. If the Customer does not intend to proceed with the purchase, or TELEARTE is unable to contact him, TELEARTE will cancel the order. TELEARTE is not obliged to sell the product at the wrong price if the error was known by the Customer according to ordinary diligence. 2.3. As far as taxes are concerned, TELEARTE works in the “margin” VAT regime or the margin regime is a special VAT regime aimed at regulating the sales of used goods by economic operators, who have purchased the same goods from private subjects.
- METHOD OF PURCHASE AND PAYMENT
3.1. TELEARTE may, at its sole discretion and without any responsibility towards the Client, refuse the booking received from the Client. If the Customer intends to purchase products that are no longer available, TELEARTE will inform the Customer.
3.2. The customer can pay by (a) main credit / debit cards upon notice by the customer to the TELEARTE Customer Service (+39 06.87911980) or in any case to the telephone exchange for TV broadcasts (+39 06.39744494) or offices (+39 06.81157093); (b) cash on delivery; (c) cash up to the maximum threshold permitted by law; (d) bank check made out to: TELEARTE S.r.l .; (e) bank transfer to:

In case of payment by credit / debit card or bank transfer, TELEARTE will ship the products only after receiving the payment authorization and, failing that, it will not proceed with the shipment. In case of payment by cash on delivery, TELEARTE will normally ship the products within 2-3 working days from the agreement reached with the TELEARTE offices.
3.3. Further information on payment methods are available by contacting TELEARTE or on the website www.teleartetv.it, Payments section. TELEARTE may store and use the data relating to the Customer’s credit / debit card for any subsequent future purchases and to proceed with any refunds, as required by the Information on Data Processing available on the website www.teleartetv.it, Privacy-policy section .
3.4. On certain products and / or for limited periods, TELEARTE offers the possibility to request payment in monthly installments (“Financing” – see Payments section). For the products for which “Financing” is available, the presenters, the switchboard operator and on the website will notify during the television broadcasts overlayed or verbally. With “Financing”, the costs of the financing procedure are due with the first installment while the shipping costs will be separate In case of “Financing”, the Customer must inform TELEARTE in the event of a change or expiry of the credit card or in the event that this is no longer valid. TELEARTE will have the right not to grant payment in Financing mode, in which case it will inform the Customer.
- DELIVERY OF PRODUCTS
4.1. TELEARTE delivers the products throughout the Italian territory, including San Marino and the Vatican City. For all other destinations Telearte collaborates with the agency Mail Boxes Etc. partner for international and national shipments. TELEARTE avails itself of the collaboration of the shipping partner Mail Boxes Etc. for deliveries on reservations of less than € 1,000.00, which will be monitored by the Customer Service of TELEARTE (tel. +39 06.87911980) and managed within 3/5 working days (excluding Sundays). The aforementioned terms run from the authorization of the payment (in the case of payment by credit / debit card), or from the date of conclusion of the Contract (in the case of payment by cash on delivery).
TELEARTE generally delivers by appointment with the Customer, for reservations exceeding the amount of € 1,000.00.
4.2. Unless otherwise agreed, TELEARTE delivers to the address provided by the Customer at the time of registration. In the case of multiple orders placed on the same day, where possible TELEARTE will deliver all available products ordered on the same day by charging a single shipping fee.
- OBLIGATIONS OF THE CUSTOMER
5.1. The Customer declares and guarantees: (i) to be of age; (ii) that the data provided by the same for the execution of the Contract are correct and truthful.
- CONSUMER’S RIGHT OF WITHDRAWAL (ONLY FOR ITALY)
6.1. The Customer, if he is a consumer pursuant to art. 3 of the Consumer Code, has the right to withdraw from the Contract, without any penalty and without specifying the reason, within 14 days from the day on which the Customer or a third party designated by him, other than the carrier, acquires physical possession of the goods. The Customer may exercise the right of withdrawal by contacting Customer Service at +39 06.87911980 or at the e-mail address firstname.lastname@example.org. To this end, the Customer may use, without being obliged to do so, the withdrawal form which can be downloaded from www.teleartetv.it in the Right of Withdrawal section (“Withdrawal Form”). The term within which the right of withdrawal can be exercised will be considered respected if the communication concerning the exercise of this right is sent before the expiry of the withdrawal period. The Customer has the right to withdraw from the Contract provided that the product is returned substantially intact. The Customer who intends to make use of the right of withdrawal must send the products without undue delay and in any case within 14 days from the day on which he communicated to TELEARTE the decision to withdraw from the Contract by registered letter with return receipt to be sent to TELEARTE S.r.l. 6.2. The return of the product through the exercise of the right of withdrawal in the aforementioned ways involves the reimbursement of the amount of the purchased product as well as, in the event of a full return of the order, of the shipping and cash on delivery costs, where present, while the direct costs of the return of the product will be charged to the customer. TELEARTE is not required to reimburse the Customer for any additional costs deriving from the Customer’s choice of a different and more expensive delivery method than the delivery method offered by TELEARTE. The refund will normally take place using the same payment method used by the Customer.
- GENERAL CLAUSES
7.1. TELEARTE may assign all or part of the rights and obligations deriving from this Agreement to third parties.
7.2. TELEARTE reserves the right to modify these General Conditions, without prior notice and without any prejudice to sales made prior to such modifications. Any changes will be effective from the date on which they will be communicated to the public and will apply to sales made after that date. The latest updated version of the General Conditions is the one available on the website www.teleartetv.it.
7.3. The Customer’s personal data are processed by TELEARTE according to the provisions of the Information on Data Processing, available on the website www.teleartetv.it, Privacy-Policy section.
7.4. This Agreement is subject to Italian law. If the Customer is a consumer pursuant to art. 3 of the Consumer Code, the competence for the resolution of any disputes arising from the interpretation, execution and termination of the Contract is devolved to the judge of the place of residence or domicile of the consumer himself, if located in Italy.
7.5.
